1. Introduction

Logi-Ink ("we," "our," or "us") is the responsible party under the Protection of Personal Information Act 4 of 2013 ("POPIA") for personal information processed through this website and our client engagements. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit logi-ink.co.za (the "Site") and when you enquire about or use our digital agency services.

We process personal information in accordance with POPIA. Where the EU General Data Protection Regulation ("GDPR") applies (for example, if you are in the European Economic Area), we also process information under the legal bases described in Section 4. Using the Site does not itself constitute consent for non-essential cookies — those require a choice via our cookie banner (see Section 2.3).

2. Information We Collect

We may collect information about you in the following ways:

2.1 Personal Information You Provide

Personally identifiable information that you voluntarily provide when you:

  • Submit our contact form or request a quote / consultation
  • Email, phone, or message us (including WhatsApp)
  • Engage us for services under a proposal or agreement

Depending on the channel, this may include:

  • Name and company name
  • Email address and phone number
  • Physical or postal address (if you provide it)
  • Project requirements, budgets, and preferences
  • Billing and payment details for contracted work (typically collected offline or via your bank / payment provider — not through a checkout on this Site)

This Site is a marketing and enquiry website. We do not operate user account registration or an online newsletter signup on the Site itself.

2.2 Automatically Collected Information

When you visit our Site, we and our operators may automatically collect technical and usage information, such as:

  • IP address (often truncated or anonymised where configured)
  • Browser type and version, operating system, and device type
  • Pages visited, approximate timestamps, and referring URLs
  • Cookies and similar technologies (subject to your cookie choice)

2.3 Cookies, Consent Mode, and Local Storage

We use a cookie consent banner that records your choice for up to 365 days in localStorage under the key logi_cookie_consent. You can change your mind at any time using Cookie Preferences in the site footer (or by clearing site data in your browser).

Your choices:

  • Accept Analytics — allows analytics (and related Consent Mode) storage so Google Analytics 4 may set cookies such as _ga.
  • Reject Non-Essential — keeps analytics and advertising storage denied. Essential Site operation continues.

We implement Google Consent Mode v2. By default, analytics_storage, ad_storage, ad_user_data, and ad_personalization are denied. After you Accept Analytics, those signals may be updated to granted. If you Reject (or have not chosen yet), Google may still receive limited cookieless measurement signals used for aggregated modelling — these are not the same as setting analytics cookies on your device. The gtag library may load in both cases so Consent Mode can apply; cookies for analytics are only set when you accept.

We also use browser localStorage to save contact-form drafts on your device and sessionStorage for page-transition UX. Those values stay on your device and are not sent to us as form drafts unless you submit the form.

High-intent clicks (for example WhatsApp, telephone, or email links to Logi-Ink) and successful contact-form submissions may generate analytics events (such as generate_lead) under Consent Mode rules described above.

3. How We Use Your Information

We use personal information to:

  • Respond to enquiries and provide quotes or consultations
  • Deliver contracted services and related project communication
  • Send service-related messages (not bulk marketing unless you opt in separately)
  • Improve the Site (analytics, performance, security, and abuse prevention)
  • Detect spam or automated abuse (including reCAPTCHA when enabled)
  • Comply with legal obligations and protect our rights

4. Legal Basis for Processing

4.1 POPIA

Under POPIA we process personal information where it is adequate, relevant, and not excessive for a defined purpose — typically: your consent (for example non-essential cookies or optional marketing), performance of a contract or steps prior to a contract, compliance with law, or our legitimate interests in operating a secure business website (balanced against your rights).

4.2 GDPR (where applicable)

Where GDPR applies, we rely on:

  • Consent: for non-essential cookies / analytics storage and any optional marketing
  • Contract: when processing is needed to perform a contract or pre-contractual steps at your request
  • Legal obligation: where required by law
  • Legitimate interests: for Site security, fraud prevention, and limited analytics modelling, where your rights do not override those interests

5. How We Share Your Information (Operators)

We do not sell your personal information. We may share it with operators (service providers) who process it on our instructions:

5.1 Service Providers / Operators

  • Formspree — processes contact-form submissions (formspree.io)
  • Google Analytics 4 / Google — website analytics under Consent Mode (measurement ID used on this Site: G-9PFB2D8G1B)
  • Google reCAPTCHA — spam protection on the contact form when enabled (subject to Google Privacy Policy and Terms of Service)
  • Hosting / CDN — including Cloudflare for delivery and security
  • Banks / payment providers — only when you pay us for contracted services (not via an on-site checkout)
  • Professional advisers — e.g. accountants or attorneys, where required

By submitting the contact form you acknowledge that Formspree may process your submission on servers outside South Africa, subject to their privacy terms and applicable transfer safeguards.

5.2 Legal Requirements

We may disclose information if required by law or in response to a valid request by a competent authority.

5.3 Business Transfers

If we are involved in a merger, acquisition, or asset sale, personal information may be transferred as part of that transaction under appropriate protections.

5.4 With Your Consent

We may share information for other purposes with your explicit consent.

6. Data Security

We implement appropriate technical and organisational measures to protect personal information against unauthorised access, alteration, disclosure, or destruction, including TLS in transit, access controls, secure hosting practices, and staff awareness. No method of transmission or storage is completely secure.

6.1 Security Compromises

If we become aware of a security compromise involving your personal information, we will notify you and the Information Regulator as soon as reasonably possible after discovery, in line with POPIA, and where GDPR applies we will observe applicable notification timelines (including the general 72-hour regulator notification expectation under GDPR where required).

7. Data Retention

We keep personal information only as long as needed for the purposes in this Policy, or longer where required by law. As a guide:

  • Contact / quote enquiries: typically up to 24 months after the last meaningful contact, unless a project starts (then retained under the engagement) or you ask us to delete sooner where legally allowed
  • Client / billing records: generally retained for at least 5 years where required for South African tax and commercial record-keeping
  • Analytics data: retained according to our Google Analytics property settings and Google’s policies

When information is no longer required, we delete or anonymise it where feasible.

8. Your Rights (POPIA & GDPR)

Under POPIA you may request access to, correction of, or deletion of your personal information, and object to certain processing (including direct marketing), subject to legal exceptions. Where GDPR applies you may also have rights to restriction, portability, and withdrawal of consent. To exercise rights, contact our Information Officer (Section 13). We may need to verify your identity before responding.

  • Access — request a copy of personal information we hold
  • Correction — request correction of inaccurate information
  • Deletion — request deletion where applicable
  • Objection — object to processing for direct marketing
  • Withdraw cookie consent — use Cookie Preferences in the footer or clear site data

9. Children's Privacy

Our Site is not directed at children under 18. We do not knowingly collect personal information from children under 18. If you believe a child has provided information, contact us and we will delete it where required.

10. International Data Transfers

Some operators (including Formspree and Google) may process information outside South Africa. Where we transfer personal information across borders we take steps consistent with POPIA section 72 (and GDPR Chapter V where applicable), such as using reputable providers and contractual / organisational safeguards.

11. Third-Party Links

The Site may link to third-party websites (including client portfolio sites and messaging apps such as WhatsApp). Their privacy practices are their own — please review their policies.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. Changes take effect when posted on this page with a revised "Last Updated" date. Please review this page periodically.
